Welcome to ReacTag! These Terms of Service (“Terms”) govern your access to and use of the ReacTag app (the “App”) and related services (collectively, the “Services”). ReacTag is developed and operated by LOAFLABS LTD. By using the Services, you agree to these Terms in full. If you do not agree to these Terms, you may not use the Services.

1. Changes to Terms

We may update these Terms from time to time by posting a revised version in the App. Any changes will become effective on the date they are posted. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

2. Privacy Policy

Your use of the Services is also subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review it carefully at [link to Privacy Policy].

3. Age Restrictions

By using the Services, you confirm that you are at least 13 years old. If you are under 13, you are not permitted to use the Services. Users aged 13 to 17 must have parental or legal guardian consent to use the Services, and guardians are responsible for supervising their use.

4. Account Registration and Responsibilities

To access certain features of the Services, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration.

  • Keep your account credentials secure and confidential.

  • Notify us immediately if you suspect unauthorized use of your account.

You are responsible for all activities conducted through your account.

5. Purchases and Pro Membership

Certain features, such as the Pro Membership, require payment. Payments are processed through Apple’s in-app purchase system, and all transactions are subject to Apple’s terms and conditions. By making a purchase, you agree to Apple’s billing policies.

Refund Policy: All purchases made through the App are non-refundable, except as required by law or Apple’s refund policies.

6. Use of the Services

ReacTag grants you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You agree not to:

  • Copy, distribute, or modify any part of the Services without our permission.

  • Use the Services for illegal purposes or violate any applicable laws.

  • Interfere with or disrupt the Services, including servers or networks.

7. User-Generated Content

ReacTag allows you to tag and manage media files stored on your device. You retain ownership of the media files, but you grant ReacTag a license to process your content solely to provide the Services.

You are solely responsible for ensuring that your use of the Services complies with applicable copyright laws and does not infringe the rights of others.

8. Third-Party Services

The App may include integrations with third-party services, such as AdMob for advertisements. ReacTag is not responsible for the content, functionality, or privacy practices of third-party services. Your interactions with these services are governed by their respective terms and privacy policies.

9. Termination

We may suspend or terminate your access to the Services if you violate these Terms. Upon termination, your right to use the Services will cease immediately.

10. Disclaimer of Warranties

The Services are provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or free of errors.

11. Limitation of Liability

To the fullest extent permitted by law, ReacTag is not liable for any indirect, incidental, or consequential damages arising from your use of the Services. This includes, but is not limited to, loss of data, revenue, or profits.

12. Indemnification

You agree to indemnify and hold ReacTag harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.

13. App Store Terms

If you download and use ReacTag through the Apple App Store, your use of the App is also governed by Apple’s terms and conditions. You agree to comply with these terms when downloading or using the App.

14. Governing Law

These Terms are governed by the laws of Canada. Any disputes arising from these Terms or your use of the Services will be resolved exclusively in the courts of Canada.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and ReacTag regarding your use of the Services and supersede any prior agreements.

17. Discontinuation of Services

ReacTag reserves the right to discontinue the Services at any time, with or without notice. If the Services are discontinued:

  • All features, including those associated with the PRO membership, will cease to be accessible.

  • Lifetime memberships are valid only for the operational life of the Services and do not guarantee continued access if the app is discontinued.

  • No refunds or compensation will be provided for purchases, including lifetime PRO memberships, except as required by law.

Where feasible, we will provide reasonable notice of the discontinuation of the Services through the app or email.
